Disclosure Requirements of Consumer Reports

Before starting a background check with Caribbean Information Bureau (CIB), the consumer must be pre-notified, by the employer, (via a written, stand alone document) that a consumer report is being obtained for employment purposes. Disclose to the consumer that an investigative report, including information as to his/her character, general reputation, personal characteristics and mode of living, may be made. The report can also include, and is not limited to, credit reports, criminal records and other public registers and history, judiciary (bankruptcies and sentences), vehicle report; education history and employment, including disciplinary measures, results for alcohol and drug consumption, and verification of social security, addresses history. This document must be given to the consumer before the consumer report is requested from CIB.

Adverse Action Process

If an employer INTENDS to take adverse reaction based on any information in the consumer report they must first provide the consumer with:

  • A copy of the report
  • Provide the name and address and telephone number of the consumer report agency (CIB)
  • Provide a statement that the consumer report agency (CIB) did not make the adverse decision and cannot provide the reason for the decision
  • Provide notice of the consumer’s right to obtain a free report within 60 days and to dispute the accuracy with the consumer report agency
